WIPO Rules in Favor of MojoHost, Orders Transfer of Infringing Website

GENEVA — A World Intellectual Property Organization (WIPO) administrative panel has issued a decision ruling against a Switzerland-based website operator accused of infringing on intellectual property belonging to MojoHost.

MojoHost’s attorney, Corey D. Silverstein of Silverstein Legal, filed a WIPO complaint in January against SeaBlue Waves, which registered the domain Mojo-Hosting.com last September.

The complaint alleged that SeaBlue Waves was utilizing the domain to unlawfully resolve to a website containing pay-per-click links to third-party websites offering competing services.

The one-person WIPO panel ordered last week that the infringing domain name be transferred to MojoHost.

"This WIPO decision reaffirms the value of the MojoHost brand and underscores our commitment to protecting our intellectual property,” MojoHost President Brad Mitchell told XBIZ. “We won't tolerate attempts to exploit our reputation and are thankful for the panel's recognition of our rights. This victory reinforces our resolve to safeguard our brand's integrity."

Silverstein added, “MojoHost has spent decades creating one of the most recognizable hosting brands in the world and it’s shameful that there are those like SeaBlue Waves that will try to profit from MojoHost’s hard work. Trying to hide in Switzerland behind privacy protection and foreign entities is not going to stop a company like MojoHost from protecting its intellectual property. We are grateful to WIPO panelist Taras Kyslyy for making the right decision.”
