MIAMI — XVideos.com’s parent company scored another knockout in a cybersquatting case decided last week.
An arbitrator ruled against the operator of XVideoRed.com, who was ordered to hand over the domain name to XVideos’ parent, WGCZ S.R.O.
XVideoRed.com, which operated as a Portuguese-language adult tube site, borrowed the look, feel and coloring of XVideos.com — one of the most popular tube sites that purportedly achieves about 4.4 billion pageviews per month.
XVideoRed.com was registered by respondent Rafael Santos of São Paulo, Brazil, in December 2016.
Santos did not respond to the claim before arbitrator Adam Taylor, a WIPO neutral, who later ordered the domain name transferred.
In his decision, Taylor found that XVideoRed.com was nearly identical to the “XVideos” trademark, that Santos did not have any legitimate rights or interests in the domain name, and that he registered and used the site as an adult portal in bad faith.
Parent company WGCZ has trademarks for the “XVideos” name in the U.S. and in the E.U.
“Clearly the respondent registered the disputed domain name with the complainant in mind,” Taylor said in his ruling. “Not only does the respondent offer identical services to the complainant, namely adult videos, the respondent’s website is strikingly similar to the complainant’s own site.
“For example, the respondent’s logo is in the same location as that of the complainant, using an identical font and color scheme — red-and-white lettering on a black background.”
WGCZ has been successful in scores of cybersquatting cases since it started up in 2006, including those against domain holders of XVideos.co, XVideoNow.com, HD-XVideos.com, New-XVideos.com XVideos.nu, XVideosToday.net, XVideosDaily.com, XVideos.net, XN--XVdeos-4va.net, XVideosxxx.club, XVideos.es and now XVideoRed.com.
