XBiz Exclusive: 2257 Update!

DENVER, Colo. — A deal has been brokered by lawyers for the Free Speech Coalition in U.S. District Court regarding the new 2257 regulations, XBiz has learned.

While FSC attorney Jeffrey Douglas told XBiz that he could not reveal details, he said there will be an announcement tomorrow at 1:30 p.m. Mountain Time, 12:30 Pacific Time, and it will be “big news and good news.”

Fellow First Amendment attorney Gregory Piccionelli added, "I cannot state in more emphatic terms that you have to be out of your mind if you don't become a member of the FSC immediately."

Partial leaks of the news have burned up webmaster boards, but Douglas said they have contained many half truths and warned “don’t believe any of it.”

On June 16, lawyers for the FSC filed motions seeking a temporary restraining order enjoining enforcement of new rules as well as a complaint seeking declaratory and injunctive relief.

In court documents obtained by XBiz (available at the link below), Justice argued that the FSC's attorneys had failed in their motion to satisfy the prerequisites for the extraordinary relief they seek and failed to show a threat of imminent hardship in the absence of a restraining order.

Justice further asserted to the Court that a restraining order would greatly increase the likelihood of distribution of child pornography.

No further information is available as of this posting, and it appears the industry will have to await for today's FSC announcement to gain a clear picture of exactly what the deal encompasses and who will be affected.
