According to legal documents obtained by XBiz, the complaint was filed in U.S. District Court against Mordechai "Moti" Kattan for allegedly duplicating and distributing the sex tape in video, CD and DVD formats.
Kattan was allegedly running a duping business out of his Woodland Hills, Calif.-based One Hour Photo store.
Red Light District owner David Joseph is seeking $3 million in damages and a permanent injunction against Kattan.
The lawsuit comes on the heels of Red Light's vigorous protection of what is considered one of the most popular videos in Internet history.
Red Light is the sole and exclusive owner of the copyrighted title '1 Night in Paris," including cover art and text.
"Red Light District is not only very active in the enforcement in their rights, but the company is leading the industry in a new era of intellectual property rights enforcement," Greg Piccionelli, Red Light's attorney, told XBiz. "Many of the producers are just sick and tired of being ripped off and this case will be the beginning of a number of cases by Red Light and others in the industry to enforce their copyrights and trademarks."
Red Light has also implemented a rewards policy for up to $100,000 for information leading to the arrest and conviction of persons involved in the illegal replication, sale or distribution of the "1 Night in Paris" video.
“Because of its intense interest and popularity, '1 Night in Paris' has been widely counterfeited,” Joseph said. “Red Light District has put an aggressive copyright and anti-counterfeit campaign in place in an effort to pursue these infringers."
An attorney representing Kattan was not available at press time.
