Malibu Media Reaches Settlement Over Legal Bills

MIAMI — Malibu Media has reached a settlement with a Florida law firm which had sued the adult studio in January, accusing it of owing $300,000 in unpaid legal bills.

A Florida judge signed off yesterday on a tentative deal between Malibu Media and Lomnitzer Law Firm.

Malibu Media is known in legal circles for filing numerous copyright cases against internet downloaders. The company filed more than 4,700 infringement lawsuits between 2015 and last year, making it, according to legal news site Law360, “one of the most prolific copyright litigants in the country.”

Although the infringement cases were largely filed by smaller local firms, Lomnitzer claims it had been retained by Malibu “to oversee the local firms that filed all those lawsuits, but that Malibu was trying to cut the firm out of the equation.”

According to the January complaint, "Malibu instructed attorneys in various jurisdictions that were representing Malibu in the nationwide litigation that was being coordinated by [Lomnitzer] to bypass the firm […] while still expecting [Lomnitzer] to pay court filing fees, process server fees, etc.”

According to Law360, “specific terms of the settlement agreement were not publicly disclosed [and] the case can be reopened in two months if the deal is not finalized.”
