Oklahoma City Relaxes Adult Zoning Regs to Head Off Litigation

OKLAHOMA CITY, Okla. — City leaders here have decided to eliminate restrictions on the location of stores selling adult toys and novelties, as long as 25 percent or less of the store's display area is designated for sale of such products.

The 5-3 decision by the Oklahoma City Council on Tuesday eliminates regulations that require stores selling those products to be at least 1,000 feet from churches, schools, libraries, playgrounds and residential property.

Stores failing to adhere to the 25 percent limit on display space will continue to face restrictions.

The Oklahoma City Council voted to amend Chapter 30, Article XIV, to head off a potentially expensive legal battle with a number of adult store owners.

Counsel for Christie's Toy Box recently filed a federal lawsuit, challenging the restrictions as unconstitutional violations of free speech, equal protection and due process guarantees.

An attorney for an Adam & Eve Stores franchise, in addition, threatened litigation in the summer.

The revised ordinance takes effect Thursday, Dec. 6.
