Falcon Foto Acquires Most of Porn Kings’ Assets With $3.2M Judgment

SEATTLE — The parent company of Porn Kings was ordered to pay Falcon Foto $3.2 million after a federal judge ruled the company infringed on 3,133 Falcon images on websites and free hosted galleries without a license.

Already, Falcon Foto attorney Robert Apgood told XBIZ that terms of the judgment "have been satisfied."

“In partial satisfaction of the judgment, Falcon Foto has acquired virtually all of Porn Kings assets,” Apgood said.

The suit, litigated in U.S. District Court in Seattle, named Porn Kings parent Noble Developments, Lucas Bradfield and Trey Hickey as defendants.

The suit claimed the defendants used Falcon Foto content regardless of their legal right to do so, and that Falcon Foto content was allegedly passed along from each subsequent owner of Porn Kings, without licensing permission.

Licensing negotiations between Falcon Foto and the first owners of Porn Kings began in 2003, but the companies failed to reach a deal for Falcon Foto-produced content. Apgood said at no point did any of the owners of Porn Kings have licensing agreements with Falcon Foto.

Apgood said infringed images were removed from Porn Kings' websites in August after Porn Kings received a cease-and-desist and a letter claiming damages, but the company refused to compensate Falcon for its use of the images during the previous 19 months.

Porn Kings operates numerous adult sites, among them Gutter.com, Chubby.com, AdultPussy.com and StonerBabes.com.
