Kener claims that, after having contracted a sexually transmitted disease on set, she was fired for expressing concern over unsanitary working conditions and refusing to work with previously used sex toys.
She said that Vivid terminated her contract the same day she brought up the issue.
Kener later filed a million-dollar lawsuit against Vivid for wrongful termination, and accused the company of failing to pay her for her shoots and profiting from sales made using her trademarked name.
Vivid's lawyers stated in court papers that Kener was an independent contractor, therefore the company was allowed to use her name for economic gain.
The settlement will be made official in writing next month. The terms of the agreement have not been disclosed.
