MindGeek Wins Domain Case Over RedTubeXXX.xxx

RIO DE JANIERO — An arbitrator ruled last week for adult entertainment conglomerate MindGeek, handing over to the company the RedTubeXXX.xxx domain name in a cybersquatting claim.

The respondent in the case, Adrian Garcia of Spain, registered the domain in September 2014 and allegedly created a copycat site of the famous RedTube.com tube site — a portal owned and operated by MindGeek.

RedTubeXXX.xxx’s tagline was, “The most awesome XXX porn videos” and it boasted on its site, “RedTubeXXX is more than RedTube because the people trust in us like the first day. And we promise to be always the best porn website in the world without doubt.”

Panelist Mario Soerensen Garcia, however, ruled that Garcia was a cybersquatter in the case, finding the disputed domain name was confusingly similar to RedTube’s trademark, that he had no rights or legitimate interests in respect of the disputed domain name, and that the domain name was registered and is being used in bad faith as a commercial adult entertainment website.

As a result, Soerensen Garcia, a Rio de Janiero arbitrator, ordered the RedTubeXXX.xxx domain transferred to MindGeek.

In recent months, the original RedTubeXXX.xxx home page was removed and now users are redirected to other adult sites that compete with MindGeek.

MindGeek owns an array of adult tube sites, including PornHub, YouPorn, ExtremeTube and Tube8.com, among numerous others. The company also operates the adult properties Reality Kings, Digital Playground, Twistys and Men.com, as well as other well-established brands.
