NEW YORK — Adult entertainment companies Vivid Entertainment and Evil Angel have both been hit with separate infringement suits by a company that owns three patents for dual-layered DVD disc technology.
Both Vivid and Evil Angel are accused of infringing on three patents that LaserDynamics USA LLC holds — U.S. Patent Nos. 6,426,927; 6,529,469; and 7,116,629.
In both suits, LaserDynamics claimed that the studios both replicate and sell porn movies using dual-layer discs. A dual-layer disc, offering about double the recording space as an ordinary DVD, offers a second physical layer within the disc itself.
LaserDynamics cites Vivid’s “Avengers XXX 2: An Axel Braun Porn Parody” and Evil Angel’s “Screwing Wall Street: The Arrangement Finders IPO” as examples of the studios’ movies that offer dual-layer discs.
LaserDynamics has filed a number of suits against mainstream companies over the trio of patents, as well. BoomBang Inc. and TVA Media Group are among others.
In the suits, LaserDynamics seeks compensatory damages, injunctions and attorneys fees against the companies. The Vivid and Evil Angel suits were filed last month at New York federal court.
Vivid officials declined comment on the suit; Evil Angel's Adam Grayson did not get into specifics but told XBIZ that "Evil Angel is actively defending itself in this matter."
