PERTH, Australia — One of Australia’s top pleasure products retailers today scored a victory at WIPO when arbitrators ordered a competing company to hand over its similar domain name.
AdultShop.com, which has 15 brick-and-mortar shops across Western Australia and Tasmania and operates online, filed a UDRP claim with arbitrators earlier this year after its owner, Malcolm Day, discovered a site with a very similar name — AdultShopWarehouse.com.au.
AdultShopWarehouse.com.au redirects to SexToysDirect.com.au, which sells adult sex toys, lingerie and BDSM gear at "warehouse" prices.
Day told XBIZ that the registrants of the domain, when faced with the cybersquatting complaint, became blind and deaf to communications over breaching AdultShop.com’s trademarks.
“They’ve ignored letters from our lawyers hence the reason for filing the application with WIPO,” Day said prior to his victory today.
WIPO arbitrators today ruled against the respondents in the case, Josh Marsden and Importa Pty Ltd., and ordered the domain AdultShopWarehouse.com.au transferred.
