Settlement to Strip Adult Retail Chain's Brand Name

GOLDEN VALLEY, Minn. — A lawyer for the Fantasys adult retail chain has signed off on a civil judgment offer that will strip the brand name off of its three stores and forbid its operators from using "fantasy" in connection with the marketing of adult sex toys and novelties.

The offer, which Fantasys operators agreed to, goes even further.

Fantasys must disable its FantasysyRUs.com website, destruct its related Facebook and Twitter pages marketing the brand, change its telephone listings and pay up $5,000.

Fantasys also will be on the hook for attorneys fees and court costs to be determined by a judge.

"Defendant’s deceptive trade practices have caused and continue to cause monetary damage to Fantasy House," the initial complaint filed by Fantasy Gifts read.

Fantasy Gifts, an adult retailer founded in 1993, claimed in a federal suit filed in November that Fantasys infringed on its blue-chip, trademarked store name by operating three stores, as well as retail website.

Fantasy Gifts operates stores in Minnesota, including in St. Louis Park, St. Paul, Lakeville, Minneapolis, Fridley, Crystal, Coon Rapids, Burnsville and Bloomington.

Fantasys, the much smaller of the two chains, has two stores in Minnesota — East Grand Forks and Ramsey — as well as one in Fargo, N.D.

Both parties recently delivered a notice of settlement to a federal judge for approval.

Attorney Clyde DeWitt, who represented Fantasy Gifts, declined comment to XBIZ because the case isn't yet finalized; attorney Randall Tigue, who represented Fantasys, wasn't immediately available for comment.
