According to a statement released by Zero Tolerance, the company is alleging Movixo violated copyright laws by illegally pirating 172 of its titles. Zero Tolerance President Greg Alves is seeking $150,000 per bootlegged title, the maximum penalty allowable for willful copyright infringement.
The complaint was filed on June 26 in U.S. District Court in Fort Lauderdale, Fla. The case has been assigned to Judge Joan A. Lenard.
According to a Zero Tolerance representative, Movixo was not buying its DVDs directly from Zero Tolerance. The company is alleging that Movixo.com customers are receiving non-authorized, low-quality copies of its copyrighted content.
Los Angeles-based First Amendment attorney Clyde DeWitt is representing Zero Tolerance in its suit, along with Joseph Lopez in Florida.
