MIAMI — A federal judge this week refused to grant early termination to Barry Goldman's probation.
Goldman is the former TorturePortal.com owner who last year agreed to an obscenity plea deal requiring three years of probation, to wear a location-monitoring device for six months and be forced to disclose all business involvement during the probation.
After 17 months into his three years of probation and completing six months of wearing a tracking device, Goldman asked the court to terminate his probation early.
But Assistant U.S. attorney Christopher Parente objected to Goldman's motion to terminate probation, noting Goldman last August was found to have violated one of six conditions of his probation. Details of the violation has not been revealed by federal prosecutors.
This week, U.S. District Judge Ursula Ungaro in Miami agreed with the government and ordered the 61-year-old filmmaker to continue probation by denying his motion.
Goldman's plea deal last year over obscenity charges spared him a trial where he could have received up to five years in federal prison and a fine of $250,000. His plea deal included one count under violating 18 U.S.C. § 1461 for mailing obscene material.
Goldman also forfeited copies of movies determined obscene by the government, including "Torture of a Porn Store Girl," "Defiant Crista Submits" and "Pregnant and Willing."
