Brazzers Says Porn Star Abandoned SaraJayBlog Suit

LOS ANGELES — Recent reports that adult star Sara Jay succeeded in her lawsuit against Brazzers over a website called SaraJayBlog.com are untrue, Brazzers says.

The veteran big-boobs MILF performer sued Brazzers at Los Angeles Superior Court claiming the adult studio had set up an unauthorized site through an affiliate with the purpose of impersonating her and gaining traffic.

Shortly after the case was filed the website was taken down, but Jay continued on with the suit, claiming that signing a Brazzers modeling contract didn't include marketing a website using her performer name.

"I sued because there was a blog out there purporting to be my 'official' blog which sent all the traffic — and sales — to Brazzers," Jay said in a statement. "Needless to say, I take any attempt to use my name to make money very seriously. We won at the trial court and  court of appeal levels.

"However, with the blog now gone and Brazzers agreeing it would not stand in the way me getting back the URL, settling made sense. We were both incurring massive amounts of time, legal expenses and costs — that I could be spending shooting or on my career. I'd rather be on set having sex for my fans than in a court room. It was a bitter battle with Brazzers but it was better for both sides to resolve it."

With the statement, Brazzers' parent, Manwin, issued its own today, refuting that a settlement was ever reached and claiming that she abandoned the suit midway through.

"In fact, after spending significant amounts on legal fees prosecuting what Brazzers maintained at all times was a frivolous action, Sara Jay did not receive a single amount, payment or money in settlement," Manwin said in the statement today.

"Instead, Sara Jay abandoned her case and released all claims she conceivably had, in exchange for Brazzers’ agreement not to proceed with its pending motions for sanctions, or file claims for malicious prosecution against her and her attorney."

In a stern statement, the Luxembourg-based adult media conglomerate, said, "Manwin, and its Brazzers brand, will continue to implement its policy of vigorously defending and opposing any and all frivolous claims and lawsuits."

But despite Manwin's statements on the case, Jay's attorney, S. Michael Kernan of Beverly Hills, Calif., said that she came out ahead against Brazzers. A Los Angeles Superior Court judge has yet to sign off on a motion to dismiss in the case, which was agreed to today.

"The rulings by the court speak for themselves," Kernan said in a one-sentence emailed response to XBIZ, referring to an appeals court ruling that decided whether the case should be bound to mandatory arbitration by a Brazzers contract, as well as a related motion at trial court.

Jay did not immediately repond to XBIZ queries over the Manwin statement.
