Girls Gone Wild's Joe Francis Sends Madonna Cease and Desist

LOS ANGELES — Girls Gone Wild founder Joe Francis has sent a cease-and-desist letter to Madonna to keep her from singing her new song called “Girls Gone Wild” at the Super Bowl or else he’ll take legal action.

TMZ.com obtained the letter and reported that it also went to her “co-conspirators” NBC and the NFL.

Francis’ lawyer is threatening to sue them for trying to get a “free ride on the valuable consumer goodwill and brand recognition” of Francis’ trademark.

“Your misappropriation of my client’s trademark will not be tolerated,” the letter said.

However, the letter offered Madonna a deal if she agreed to the following terms:

  • Negotiate an immediate licensing agreement for the use of Francis’ trademark;
  •  Account for the number of times Madonna has already used the trademark; and,
  •  Not perform the song at the Super Bowl.

Francis’ lawyers have requested a response by 5 p.m. today.
